Report Copyright Violation

PlanetAbroad highly respects your intellectual property. We try our best to prevent any violations, however, as we provide users with an open system it is possible that in rare cases content is posted which violates the Terms and Conditions. This content, including pornography as well as texts, images, videos and further types of content infringing copyrights, privacy rights, publicity rights or other intellectual property rights will be removed.

If you encounter content you believe violates our Terms and Conditions and which you would like to have removed, please notify us via e-mail at copyright@planetabroad.com.

In the event that you believe your work has been copied in a way that constitutes copyright infringement or if you believe that your intellectual property rights have been otherwise violated, please provide us with an e-mail containing the following information:

-Your name, address, telephone and email
-Identification of the copyrighted work or other intellectual property you claim has been infringed
-An electronic or physical signature of the person authorized to act on behalf of the owner of the copyright or other intellectual property interest
-the complete URL of the material that you claim is infringing
-A statement by you that you have a good faith belief that the disputed use is not authorized by the copyright or intellectual property owner, its agent, or the law
-A statement by you that the above information in your notice is accurate and a statement, under penalty of perjury, that you are the copyright or intellectual property owner or authorized to act on the copyright or intellectual property owner's behalf.

After receiving your mail, we undertake further investigations and try to react within 4 business days after receipt of the notice.

Privacy/Terms

PlanetAbroad takes your privacy very seriously. To fully benefit from the site however some functionalities require collecting private data. As your privacy is of highest importance to us we guarantee that no personally identifiable information will be sold to third parties.

All changes in the way PlanetAbroad handles personally identifiable data will be posted in updates to this Privacy Policy.

The following policy highlights the different personally identifiable information collected, the usage, with whom it may be share, how to contact us as well as were to change your account information.

Effective Date:

Information Collection:
In order to offer a social network for travelers, PlanetAbroad allows you to become a member and submit information including your name, e-mail address and optionally further information concerning your profile.

Furthermore, non-personally identifiable data, including your IP address and browser is collected.

Use of Information:
Personal information will be displayed in your profile based on your personal preferences set. Furthermore, your email address will by default be used to occasionally contact you. Should this not be desired it is at all times possible to opt out of these mailings.
In addition, we will disclose your personally identifiable information if we reasonably believe we are required to do so by law, regulation or other government authority or to protect the rights and property of PlanetAbroad, its affiliates or the public. We may also cooperate with law enforcement agencies in any official investigation and we may disclose your personally identifiable information to the relevant agency in doing so.

It is at all times possible to review, revise and deactivate your profile.

Use of Cookies:

User Agreement

This is the user agreement for using PlanetAbroad.com. Before signing up you are required to read and accept all terms and conditions outlined in this document as well as the Privacy Statement. If you don't agree to these terms and conditions as well as the Privacy Statement, you may not use our platform. This agreement can be modified by PlanetAbroad at any given time by posting the new version on our website. Your continued membership stands for the acceptance to agree to the new agreement.

PlanetAbroad Service:
PlanetAbroad is a travel destination recommendation and content aggregation service. In addition, members can exchange their experiences, views and tips on destinations and travel in general through an attached social network.

Eligibility:
Membership in Planetabroad is open to anyone seeking travel destination recommendations, further (mostly third party) content on a specific destination as well as interacting with likeminded travlers from around the world.
For membership you need to be above 18 years of age. You may not have been previously suspended from membership and apply again. You may not have more than one active account and you may not sell or trade that account with another party.

Use of Service:
You can use the PlanetAbroad service according the conditions in this user agreement. PlanetAbroad may stop or refuse the service at any given point of time without prior notice to any user. You are fully responsible for your account, especially your login and password information, and all activities that occur under your account. In a case of unauthorized use of your account by a third party, you agree to immediately notify PlanetAbroad. PlanetAbroad is in no way liable for any loss or damage due to the non-compliance with this paragraph. You agree to comply with all applicable local rules including but not limited to rules regarding online conduct and acceptable content.

Termination:
You agree that at any point in time, at the sole discretion of PlanetAbroad, your account can be immediately terminated. At any point in time you as well have the right to terminate your account by notifying PlanetAbroad per email at membership@PlanetAbroad.com. The termination of the account comprises the removal of access to all service offerings.

User Conduct:
You guarantee that no materials of any kind submitted through your account or otherwise posted will violate or infringe upon the rights of third parties, such as copyright and trademark rights. You agree that you may not use the service in any unlawful manner or in any other manner that could damage, disable, overburden or impair the service. You agree not to use the service to:
- register for more than one user account, register for a user account on behalf of an individual other than yourself, or register for a user account on behalf of any group or entity;
- impersonate any person or entity, or falsely state or otherwise misrepresent yourself, your age or your affiliation with any person or entity;
- upload, post, transmit, share or otherwise make available any unsolicited or unauthorized advertising, solicitations, promotional materials, "junk mail," "spam," "chain letters," "multi-level-marketing," or any other form of solicitation;
- intimidate or harass another; upload, post, transmit, share, store or otherwise make available content that would constitute, encourage or provide instructions for a criminal offense, violate the rights of any party, or that would otherwise create liability or violate any local, state, national or international law;
- use or attempt to use another's account, service or system without authorization from PlanetAbroad, or create a false identity on the Service or the Site.

Information Provided on this Website:
In the course of using the service, users may provide information about themselves which may be visible to certain other users. By posting user content to the service, you authorize and direct us to make such copies thereof as we deem necessary in order to facilitate the posting and storage of the user content on the Site. By posting user content to any part of the site, you automatically grant, and you represent and warrant that you have the right to grant, to PlanetAbroad an irrevocable, perpetual, non-exclusive, transferable, fully paid, worldwide license (with the right to sublicense) to use, copy, publicly perform, publicly display, reformat, translate, excerpt (in whole or in part) and distribute such user content for any purpose on or in connection with the site or the promotion thereof, to prepare derivative works of, or incorporate into other works, such user content, and to grant and authorize sublicenses of the foregoing. You may remove your user content from the site at any time. If you choose to remove your user content, the license granted above will automatically expire, however you acknowledge that PlanetAbroad may retain archived copies of your user content. Additionally, we cannot guarantee the authenticity of any data which users may provide about themselves or relationships they may describe.

Access to Service:
Use of manual or automated software, devices, or other processes to "crawl" or "spider" any web pages contained in the PlanetAbroad website is strictly prohibited. You agree not to monitor or copy, or allow others to monitor or copy, our web pages or the content included herein. Furthermore, you agree not to take any action that interferes with the proper working of or places an unreasonable load on our infrastructure, including but not limited to unsolicited communications, attempts to gain unauthorized access, or transmission or activation of computer viruses.

PlanetAbroad is not responsible or liable in any manner for any user content or third party applications, software or content posted on the site or in connection with the service, whether posted or caused by users of the site, by PlanetAbroad, by third parties or by any of the equipment or programming associated with or utilized in the site or the service. IN NO EVENT WILL PLANETABROAD OR ITS DIRECTORS, EMPLOYEES OR AGENTS BE LIABLE TO YOU OR ANY THIRD PERSON FOR ANY INDIRECT, CONSEQUENTIAL, EXEMPLARY, INCIDENTAL, SPECIAL OR PUNITIVE DAMAGES, INCLUDING FOR ANY LOST PROFITS OR LOST DATA ARISING FROM YOUR USE OF THE SITE OR THE SERVICE OR ANY OF THE SITE CONTENT OR OTHER MATERIALS ON, ACCESSED THROUGH OR DOWNLOADED FROM THE SITE, EVEN IF PLANETABROAD IS AWARE OR HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. NOTWITHSTANDING ANYTHING TO THE CONTRARY CONTAINED HEREIN, PLANETABROAD'S LIABILITY TO YOU FOR ANY CAUSE WHATSOEVER, AND REGARDLESS OF THE FORM OF THE ACTION, WILL AT ALL TIMES BE LIMITED TO THE AMOUNT PAID, IF ANY, BY YOU TO PLANETABROAD FOR THE SERVICE DURING THE TERM OF MEMBERSHIP, BUT IN NO CASE WILL PLANETABROAD'S LIABILITY TO YOU EXCEED USD500. YOU ACKNOWLEDGE THAT IF NO FEES ARE PAID TO PLANETABROAD FOR THE SERVICE, YOU SHALL BE LIMITED TO INJUNCTIVE RELIEF ONLY, UNLESS OTHERWISE PERMITTED BY LAW, AND SHALL NOT BE ENTITLED TO DAMAGES OF ANY KIND FROM PLANETABROAD, REGARDLESS OF THE CAUSE OF ACTION.

CERTAIN STATE LAWS DO NOT ALLOW LIMITATIONS ON IMPLIED WARRANTIES OR THE EXCLUSION OR LIMITATION OF CERTAIN DAMAGES. IF THESE LAWS APPLY TO YOU, SOME OR ALL OF THE ABOVE DISCLAIMERS, EXCLUSIONS OR LIMITATIONS MAY NOT APPLY TO YOU, AND YOU MAY HAVE ADDITIONAL RIGHTS.

Indemnification:
By accepting this user agreement, you agree to indemnify and otherwise hold harmless PlanetAbroad, its officers, employees, agents, subsidiaries, affiliates and other partners from any direct, indirect, incidental, special, consequential or exemplary damages resulting from i) your use of the PlanetAbroad Service; ii) unauthorized access to or alteration of your communications with or through the PlanetAbroad Service, or iii) any other matter relating to the PlanetAbroad Service. Any business transactions which may arise between users from their use of PlanetAbroad are the sole responsibility of the users involved.

Without limitation of the terms and conditions set forth in our Privacy Policy, you understand and agree that PlanetAbroad may disclose personally identifiable information if required to do so by law or in the good faith belief that such disclosure is reasonably necessary to comply with legal process, enforce this user agreement, or protect the rights, property, or safety of PlanetAbroad, its users, and the public.
